Offence Wording
- Possession of weapon for dangerous purpose
88 (1) Every person commits an offence who carries or possesses a weapon, an imitation of a weapon, a prohibited device or any ammunition or prohibited ammunition for a purpose dangerous to the public peace or for the purpose of committing an offence.
- Punishment
(2) Every person who commits an offence under subsection (1) [possession d'arme dans un but dangereux – infraction]
- (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years; or
- (b) is guilty of an offence punishable on summary conviction.

- Carrying weapon while attending public meeting
89 (1) Every person commits an offence who, without lawful excuse, carries a weapon, a prohibited device or any ammunition or prohibited ammunition while the person is attending or is on the way to attend a public meeting.
- Punishment
(2) Every person who commits an offence under subsection (1) [port d'une arme lors d'une réunion publique] is guilty of an offence punishable on summary conviction.

- Carrying concealed weapon
90 (1) Every person commits an offence who carries a weapon, a prohibited device or any prohibited ammunition concealed, unless the person is authorized under the Firearms Act to carry it concealed.
- Punishment

Mr. Skinner was the passenger in a car that was driving in a busy residential area of north end Halifax at around 11 a.m. He had a semi-automatic pistol and directed the driver to follow another car. When the other car stopped, Mr. Skinner drove past and Mr. Skinner fired six shots in the direction of the other vehicle with the pistol. Five of the shots hit the vehicle. Mr. Skinner was youthful but had a significant criminal record including three previous convictions for possession of a loaded prohibited or restricted firearm and was subject to a firearms prohibition order at the time of the offences. He had also already pleaded guilty to offences arising out of his arrest the next day when he was found in a vehicle with the same handgun he had used the previous day, but reloaded, tucked into his waistband. For those offences, the Court had imposed the jointly recommended sentence of five years in custody in addition to four months of pre-trial custody. The appeal court did not interfere with the judge’s discretion to order that the sentences for the offences arising out of the shooting be served concurrently to the sentences for the offences arising out of the arrest." Offence Wording
- Possession contrary to order
117.01 (1) Subject to subsection (4) [exception à la violation d'une ordonnance d'interdiction], every person commits an offence who possesses a firearm, a cross-bow, a prohibited weapon, a restricted weapon, a prohibited device, any ammunition, any prohibited ammunition or an explosive substance while the person is prohibited from doing so by any order made under this Act or any other Act of Parliament.
- Failure to surrender authorization, etc.
(2) Every person commits an offence who wilfully fails to surrender to a peace officer, a firearms officer or a chief firearms officer any authorization, licence or registration certificate held by the person when the person is required to do so by any order made under this Act or any other Act of Parliament.
- Punishment
(3) Every person who commits an offence under subsection (1) [possession contraire à une ordonnance – ordonnance] or (2) [défaut de se conformer à une autorisation, etc.]
- (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years; or
- (b) is guilty of an offence punishable on summary conviction.
- Exception
- (4) Subsection (1) [possession contraire à une ordonnance – ordonnance] does not apply to a person who possessed a firearm in accordance with an authorization or licence issued to the person as the result of an order made under subsection 113(1) [levée d'une ordonnance d'interdiction pour subsistance ou emploi].
